NYREER’s Contract Warranties

NYREER Five-Year Warranty. NYREER warranties the components of the System against breakdown or degradation in electrical output of more than ten (10%) percent from the original rated electrical output resulting from normal use for a period of five years after installation. This warranty shall cover the costs of repair or replacement of defective components or, at the option of NYREER, serviceable used parts that are equivalent or superior to new parts in performance. This warranty extends only to products purchased from NYREER. This warranty does not extend to any product that has been damaged or rendered defective (a) as a result of accident, misuse, or abuse; (b) as a result of an act of god; (c) by operation outside the usage parameters stated within user manuals; (d) by use of parts not sold or installed by NYREER; (e) by modification of the product; (f) a result of war or terrorist attack; (g) as a result of service by anyone other than NYREER; (h) or acts of vandalism. Except as expressly set forth in this warranty, NYREER makes no other warranties expressed or implied, including any implied warranties or merchantability and fitness for a particular purpose. NYREER expressly disclaims all warranties not stated in this warranty, any implied warranties not that may be imposed by law are limited to the terms of this expressed warranty.

NYREER Two-Year Warranty. If a battery back-up is installed with the System, the battery shall be covered by a Two-year nontransferable warranty after installation. NYREER warranties the battery system from breakdown as the result of normal use and covers the costs of repair or replacement of a defective battery, or at the option of NYREER, the use of serviceable used parts that are equivalent or superior to new parts in performance.

The Five-Year Warranty shall be transferable to subsequent owners.

Normal Use. While all due care will be taken, NYREER will not accept responsibility for components supplied by the Customer or for goods that are used or dealt with in any way that is not usual. NYREER will not be responsible for loss or damage to any of the Customer’s property, real or personal, or for any faults or defects in the System due to misuse or damage caused by others, including the Customer, or if the System fails to operate due to any or all of the following including but without limitation: (a) an event of Force Majeure; (b) atmospheric electrical discharges; (c) flooding or water damage; (d) improper maintenance by the Customer; (e) the Customer has failed to maintain the Site to ensure that there is not obstruction to the successful operation of the System; (f) unauthorized repairs, modifications or additions by the Customer; (g) faulty operation of Customer equipment; (h) the System fails to operate because of climate conditions beyond that which could be reasonably anticipated having regard to Site location and recorded weather patterns, or any other cause beyond the control of NYREER.
